About These Terms

These Terms & Conditions apply when you access the Nangs365 website, make an enquiry, request a quote, or place an order with Nangs365. Our contact and dispatch area is Melbourne West Dispatch Area, Laverton North VIC 3026. You can contact us at contact@nangs365.com or through the WhatsApp link displayed on this website.

Business and Trade Enquiries

This website is intended primarily for business and trade customers, including hospitality venues, cafes, bakeries, caterers, dessert businesses, and event operators. We may request reasonable information about the customer, business, intended culinary use, delivery location, and order requirements before accepting an order.

WhatsApp Enquiries and Order Formation

The website is a product catalogue and enquiry channel. It does not accept purchases through an online cart or checkout. Sending a WhatsApp message, asking for a quote, or discussing stock does not by itself create a binding order.

An order is accepted only when Nangs365 confirms the products, quantities, price, availability, delivery details, and any payment requirements in writing. If a written quote specifies an expiry date or other conditions, those terms also apply.

Products and Responsible Supply

Nitrous oxide products supplied by Nangs365 are intended only for lawful culinary, food preparation, and hospitality use. They must not be used for human inhalation, intoxication, or any other unlawful or unsafe purpose.

Customers must follow all product labels, safety instructions, storage requirements, and applicable laws. We may refuse or cancel supply where we know, reasonably ought to know, or have reasonable cause to believe that a product is intended for misuse or unlawful resale or supply. We may also ask reasonable questions or request supporting business information before accepting an order.

Product Information and Availability

We take reasonable care to keep product descriptions and images accurate. Packaging, colour, or presentation may change without notice where the product remains materially equivalent. All products and quantities remain subject to stock availability and written confirmation.

Pricing and Payment

Website prices, where displayed, are indicative and may change. The final price, any applicable GST treatment, and payment instructions will be confirmed in writing before the order is accepted. If a material pricing or product information error is discovered before fulfilment, we will contact the customer to correct the order or cancel it and refund any amount already paid for the affected products.

Delivery

Delivery for confirmed orders within our Melbourne service area is free. Delivery eligibility and timing must be confirmed on WhatsApp. We aim to arrange eligible local deliveries within 24 hours where stock and delivery capacity are available, but this is an estimate and not a guaranteed delivery time.

Customer Information

The customer is responsible for providing accurate contact, business, order, and delivery information. We are not responsible for delay or failed delivery caused by materially inaccurate or incomplete information supplied by the customer, except to the extent responsibility cannot lawfully be excluded.

Returns and Consumer Rights

Returns and refunds are handled under our Returns & Refunds Policy. Nothing in these terms excludes, restricts, or modifies the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded. Business purchasers may also qualify as consumers under the Australian Consumer Law in some circumstances.

Liability

To the maximum extent permitted by law, Nangs365 is not liable for indirect or consequential loss that was not reasonably foreseeable or was caused by unlawful use, misuse, incorrect storage, or failure to follow product instructions. This limitation does not apply where liability cannot lawfully be excluded or limited.

Website Availability and Third-Party Services

We do not guarantee uninterrupted access to the website, WhatsApp, or other third-party services. Third-party services have their own terms and privacy practices.

Changes to These Terms

We may update these terms from time to time. The terms applying to an accepted order are those provided or available when that order was accepted, together with any additional terms agreed in writing.

Governing Law

These terms are governed by the laws of Victoria, Australia. The parties submit to the courts of Victoria and any courts entitled to hear appeals from them, subject to any applicable law that provides otherwise.
